It is a product of human creation.<\/p>\n\n\n\n<p><strong>WIPO ( World Intellectual Property Organization )<\/strong> was established by the WIPO Convention in 1967<\/p>\n\n\n\n<ul><li>The WIPO is a specialized agency of the United Nations.<\/li><li>It promotes the protection of IP throughout the world.<\/li><li>Its headquarters are in Geneva, Switzerland.<\/li><\/ul>\n\n\n\n<p>Intellectual Property <strong>comprises 2 distinct forms:<\/strong><\/p>\n\n\n\n<p><strong>* Literary &amp; Artistic Works<\/strong> &#8211; They are books, paintings, musical compositions, plays, movies, radio\/tv programs, performances, &amp; other artistic works. \u00e0 protected by COPYRIGHT<\/p>\n\n\n\n<p><strong>* Industrial Property &#8211; <\/strong>describes physical matter that is the product of an idea or concept for commercial purposes<\/p>\n\n\n\n<p><strong>How are they Protected?<\/strong><\/p>\n\n\n\n<p>* By Patented objects<\/p>\n\n\n\n<p>* By Trademarks<\/p>\n\n\n\n<p>* By Industrial Designs<\/p>\n\n\n\n<p>* By Trade Secrets<\/p>\n\n\n\n<p>* By Layout-designs<\/p>\n\n\n\n<p>* By Geographical Indications<\/p>\n\n\n\n<p><strong>Patent <\/strong><strong>\u00e0<\/strong> A patent describes an invention for which the inventor claims the exclusive right.<\/p>\n\n\n\n<p>Inventions Patentable if<\/p>\n\n\n\n<ul><li>New (novel)<\/li><li>useful<\/li><li>not obvious<\/li><li>pertains to <strong>Patentable Subject Matter &#8211; <\/strong>Invention<ul><li>Relates to A Process Or Product Or Both<\/li><\/ul><ul><li>Involves an Inventive Step<\/li><\/ul><ul><li>Be Capable of Industrial Application<\/li><\/ul><ul><li>A Machine<\/li><\/ul><\/li><\/ul>\n\n\n\n<p><strong>Life and Duration<\/strong><\/p>\n\n\n\n<ul><li>Term of the patent is <strong>20 years from the date of filling<\/strong> for all types of inventions.<\/li><li>Priority date- first to file<\/li><li><strong>The date of patent is the date of filing the application for patent.<\/strong><\/li><li>The term of the patent is counted from this date<\/li><\/ul>\n\n\n\n<p><strong>Fees for filing patent<\/strong><\/p>\n\n\n\n<ul><li>The Government fee for filing a patent application in India is Rs.750\/- for individuals and Rs.3,000\/- for legal entities.<\/li><li>No fee for 1st and 2nd year<\/li><li>Renewal fee, on yearly basis, is required to be paid for 3rd to 20th for keeping the patent in force.<\/li><li>Patent lapses if renewal fee is not paid within the prescribed period.<\/li><\/ul>\n\n\n\n<p><strong>Is patent granted in one country enforceable in another country<\/strong><\/p>\n\n\n\n<ul><li><strong>No,<\/strong> there is nothing like a global patent or a world patent.<\/li><li>Patent rights are essentially territorial in nature<\/li><li>Granting a patent in one country of the Union does not force other countries to grant the patent for the same invention.<\/li><li>The refusal of the patent in one country does not mean that it will be terminated in all the countries<\/li><\/ul>\n\n\n\n<p><strong>The IPR protection works in numerous ways:<\/strong><\/p>\n\n\n\n<ul><li>Provides fair and effective incentive for innovation<\/li><li>Protects pharma companies against potential infringers<\/li><li>Provides strong enforcement tools for defending infringed patents<\/li><\/ul>\n\n\n\n<p><strong>The following would not qualify as patents:<\/strong><\/p>\n\n\n\n<ul><li>An invention, which is&nbsp; frivolous&nbsp; or&nbsp; which claims anything obvious or contrary to the well established natural law. An invention, the&nbsp; primary or intended use of which would be contrary to law or morality or injurious to public health<\/li><li>A discovery, scientific theory, or mathematical method<\/li><li>A mere discovery of any new&nbsp; property or new use for a known substance or of the mere use of a known process, machine, or apparatus&nbsp; unless such known process results in a new product or employs at least one new reactant<\/li><li>A substance obtained by a mere admixture resulting only in the aggregation of the properties of the components there of or a process for producing such substance<\/li><li>A mere arrangement or re-arrangement or duplication of a known device each functioning independently of one another in its own way<\/li><li>A method of agriculture or horticulture<\/li><li><strong>Any&nbsp; process for&nbsp; the medicinal, surgical, curative, prophylactic&nbsp; diagnostic, therapeutic&nbsp; or other treatment of human beings or any process for a similar treatment of animals to render them free of disease or to increase their economic value or that of their products<\/strong><\/li><li>An invention relating to atomic energy<\/li><li>An&nbsp; invention,&nbsp; which is&nbsp; in&nbsp; effect, is&nbsp; traditional knowledge<\/li><\/ul>\n\n\n\n<p><strong>Trademark:<\/strong><\/p>\n\n\n\n<ul><li>A symbol, logo, word, sound, color, design, or other device that is used to identify a business or a product in commerce.<\/li><li>Different Symbols are :<\/li><\/ul>\n\n\n\n<p><strong>\u2122 <\/strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Intent to use application filed for product<\/p>\n\n\n\n<p><strong>SM<\/strong>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Intent to use application filed for services<\/p>\n\n\n\n<p><strong>\u00ae<\/strong> &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Registered trademark<\/p>\n\n\n\n<ul><li>Trademark is <strong>valid for 10 years<\/strong> from the date of application which <strong>may be renewed for further period of 10 years <\/strong>on payment of prescribed fees.<\/li><li><strong>Service mark Rights<\/strong> are <strong>reserved exclusively for owners for 17<\/strong> year &amp; it can also be renewed.<\/li><li>The Govt. fees is Rs. 2,500 for each class of goods or services<\/li><\/ul>\n\n\n\n<ul><li>A trademark is a sign <strong>Used on,<\/strong> or in connection with the marketing of goods or services.<\/li><li><strong>\u201cUsed on\u201d<\/strong> the goods means that it may appear not only on the goods themselves but on the <strong>container or wrapper<\/strong> in which the goods are when they are sold<\/li><\/ul>\n\n\n\n<p>Trademark<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"338\" height=\"208\" src=\"https:\/\/medicineplexus.com\/wp-content\/uploads\/2020\/02\/image-213.png?w=338\" alt=\"\" class=\"wp-image-630\" srcset=\"https:\/\/medicineplexus.com\/wp-content\/uploads\/2020\/02\/image-213.png 338w, https:\/\/medicineplexus.com\/wp-content\/uploads\/2020\/02\/image-213-300x185.png 300w\" sizes=\"(max-width: 338px) 100vw, 338px\" \/><\/figure>\n\n\n\n<p><strong>Copyrights<\/strong><\/p>\n\n\n\n<ul><li>It is a right which Grants protection to the unique expression of Ideas.<\/li><li>Copyright law protects the expression of an idea. Not the idea itself.<\/li><li>Copyright lasts for the- Author\u201fs lifetime + 50 years from the end of the calendar year in which the author dies,<\/li><li>Copyright protection always expires on December 31 of the last calendar year of protection<\/li><\/ul>\n\n\n\n<p><strong>Geographical indications<\/strong><\/p>\n\n\n\n<ul><li>indications, which identify as good as originating in the territory of a country or a region or locality in that territory where a given quality, reputation, or other characteristic of the goods is essentially attributable to its geographical origin<\/li><\/ul>\n\n\n\n<p><strong>Infringement<\/strong><\/p>\n\n\n\n<ul><li>Any reproduction, use , distribution, performance, etc. of the work without the permission of the owner.<\/li><li>An identical or substantial similar reproduction is also covered<\/li><li>Infringement \u2013 Damages \u2013 Injunction<\/li><\/ul>\n\n\n\n<p><strong>Remedies for patent infringement<\/strong><\/p>\n\n\n\n<ul><li>A suit can lie in the District or High court<\/li><li>It may issue an injunction either to prevent the infringer from any further use &amp; award damages to the patent owner or will pay the patent owner royalties for further use.<\/li><li>Punishment extends from 6 months to 3 years<\/li><li>A permanent bans on engaging in commercial activities<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Intellectual Property Right Intellectual Property is a property that arises from the human intellect.
